1. Agreement to Terms
By accessing or using the RecruShare platform (the "Platform"), operated by TTE Staffing LLC ("RecruShare," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
2. Eligibility
You must be at least 18 years old and legally permitted to work as an independent contractor in your jurisdiction to use RecruShare as a recruiter. By using the Platform, you represent and warrant that you meet these requirements.
3. Platform Description
RecruShare is a marketplace platform that connects independent freelance recruiters with job openings posted by hiring companies. RecruShare facilitates the relationship but is not your employer and is not a staffing agency on your behalf. Recruiters are independent contractors, not employees of RecruShare or TTE Staffing LLC.
4. Account Registration
To access recruiter features, you must create an account and complete the application process. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your login credentials confidential
- Notify us immediately of any unauthorized account access
- Be responsible for all activity that occurs under your account
We reserve the right to reject, suspend, or terminate any account at our sole discretion.
5. Recruiter Obligations
As a recruiter on the Platform, you agree to:
- Only submit candidates you have contacted and who have consented to be submitted
- Accurately represent candidates' qualifications and experience
- Not submit the same candidate for conflicting roles without disclosure
- Comply with all applicable employment, privacy, and anti-discrimination laws
- Not engage in any form of misrepresentation, fraud, or deceptive practice
- Maintain professional conduct in all communications through the Platform
6. Commissions and Payments
Commission rates and structures are displayed per job listing before you request access. Commissions are earned upon successful placement, defined as a candidate reaching "Placed" status in the Platform.
- Commissions are subject to a typical payout timeline of 60-90 days after the candidate's start date, once client invoices are settled.
- We reserve the right to withhold or reverse commissions in cases of fraud, misrepresentation, or candidate withdrawal before the guarantee period ends.
- Commission rates may be updated at any time for future job listings. Rates on accepted jobs are honored.
7. Prohibited Conduct
You may not use the Platform to:
- Circumvent the Platform to arrange direct placements outside RecruShare for jobs discovered on the Platform
- Scrape, copy, or redistribute job listings or candidate data
- Upload malicious code, spam, or disruptive content
- Impersonate any person or entity
- Violate any applicable law or regulation
- Harass, abuse, or harm other users or RecruShare staff
Violation of these prohibitions may result in immediate account termination and forfeiture of pending commissions.
8. Intellectual Property
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, and software, are owned by TTE Staffing LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Confidentiality
Job details, client identities, commission structures, and candidate information accessed through the Platform are confidential. You agree not to disclose this information to third parties outside of what is necessary to perform your recruiting activities on the Platform.
10. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that any specific jobs or placements will be available. We do not guarantee any level of earnings.
11. Limitation of Liability
To the fullest extent permitted by law, TTE Staffing LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including lost commissions, lost profits, or loss of data, even if advised of the possibility of such damages. Our total liability to you shall not exceed the commissions paid to you in the 3 months preceding the claim.
12. Termination
Either party may terminate the relationship at any time. We may suspend or terminate your account immediately, without notice, for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Earned commissions for completed placements prior to termination will be paid per normal schedule, subject to Section 6.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or a notice on the Platform. Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms.
